Doporučená rozhodčí doložka do uzavíraných smluv nebo faktur

Smluvní strany se výslovně dohodly, že veškeré majetkové spory vyplývající z této Smlouvy nebo vzniklé v souvislosti s ní, budou s vyloučením pravomoci obecných soudů rozhodovány s konečnou platností podle českého práva v rozhodčím řízení podle zákona č. 216/1994 Sb., o rozhodčím řízení a o výkonu rozhodčích nálezů, v platném a účinném znění, jediným rozhodcem jmenovaným společností ARBITER, spol. s r.o., IČ 629 67 151, se sídlem Litvínovská 591, 190 00 Praha 9 – Prosek (dále jen ,,Společnost,,) a zapsaným v Seznamu rozhodců vedeném společností ARBITER, spol. s r.o. Smluvní strany se dále výslovně dohodly, že v rozhodčím řízení se bude postupovat v souladu s Jednacím řádem pro rozhodčí řízení, s Pravidly o nákladech rozhodčího řízení a s Vnitřním organizačním řádem, vydaných společností ARBITER spol. s r.o., se kterými byly smluvní strany před podpisem této Smlouvy seznámeny a které jsou veřejně dostupné na stránkách www.arbiter-rozhodce.cz.
 

Recommended Arbitration Clause to Your contracts and invoices

Contractual Parties herein agree that any and all property disputes, which may arise in the future out of this Contract and/or in connection with it, even in case that this contract would be avoided, cancelled and/or withdrawn from (hereinafter ´´the disputes only´´), shall be resolved with preclusion of ordinary state courts authority through arbitral proceedings, as enabled by the Act No. 216/1994 Coll., on arbitral proceedings and the execution of arbitration awards.
The Contractual Parties herein agree that any dispute shall be decided by sole arbitrator appointed by the statutory body of ARBITER, spol. s r.o. (ARBITER, Ltd.), company registration number 629 67 151, and selected from the list of arbitrators, registered in the list kept by the ARBITER, spol. s r.o.
The Contractual Parties herein agree that any dispute shall be arbitrated in an arbitral procedure according to the Arbitration Rulings, the respective Order concerning the arbitration costs and the Rules of Organization, issued by ARBITER, spol. s r.o. and made public at the internet address www.arbiter-rozhodce.cz. The Contractual Parties have explicitly stated to have had the opportunity to read the Arbitration Rulings, the respective Order concerning the arbitration costs and the Rules of Organization before the signature of the Contract.
